Hickory Tavern Spin to Win Holiday Sweepstakes OFFICIAL RULES + Terms and Conditions

1. ELIGIBILITY: Open to legal U.S. residents, residing in North Carolina, South Carolina, Tennessee, and Alabama, who live within thirty (30) miles of a participating Hickory Tavern location and are 18 years of age and older at time of Game Play (“Entrant”). All applicable federal, state and local laws and regulations apply. Void outside North Carolina, South Carolina, Tennessee, Alabama and where prohibited. Employees of CCBCC Operations, LLC (“Sponsor”), Red Moon Marketing (“Administrator”), Hickory Tavern, their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively “Promotion Entities”) and the immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each, are not eligible to participate or win.
2. PROMOTION PERIOD: The Hickory Tavern Spin to Win Holiday Sweepstakes (the “Promotion”) begins at 11:59 pm Eastern Time (“ET”) on November 25, 2021 and ends at 11:59 pm. ET on December 31, 2021 (“Promotion Period”).
3. HOW TO ENTER/PLAY: There is NO PURCHASE NECESSARY to participate. A purchase does not increase your chances of winning.
THERE ARE TWO WAYS TO ACCESS THE WEBSITE TO ENTER THE PROMOTION:
• VIA QUICK RESPONSE CODE ON DISPLAY: During the Promotion Period, look for special Promotion displays at participating Hickory Tavern locations with a Quick Response (“QR”) code. Scan the QR code with your web-enabled mobile device (“Device”) to be directed to the Website (defined below).
• VIA WEBSITE: During the Promotion Period, go to https://digicpn.com/p/jxexcd (“Website”).
During the Promotion Period, go to the Website to play the virtual spin the wheel game. Spin the wheel where indicated (“Game Play”) to reveal if you have won a prize, subject to verification. If you win a prize, follow the instructions to complete and submit the registration form. By completing the registration form, you understand that your email address will be added to Hickory Tavern Fan Club email distribution and will receive coupons via email. If you are not an instant winner, you may follow the directions to enter the Sweepstakes (“Sweepstakes”) drawing. All on-screen wins are subject to verification. Sponsor’s computer is the only allowed proof of a winning Game Play. Screen shots, photos, or copies of winning plays are not proof of a winning Game Play. All Game Plays/Entries (defined below) become the property of Sponsor. Receipt of Game Plays/Entries may be acknowledged, but such acknowledgment does not constitute any representation as to eligibility. Limit one (1) Game Play/Entry per person per week. For the purposes of this Promotion, a week is defined as beginning at 11:59 pm ET each Thursday and ending at 11:59 pm ET each Wednesday, with the exception of the last week, which will end at 11:59 pm ET on December 31, 2021. Any attempt by any Entrant to obtain more than the stated number of Game Plays/Entries by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that Entrant’s Game Plays/Entries and that Entrant may be disqualified from the Promotion. Any use of robotic, repetitive, automatic, programmed or similar registration/Game Play methods or agents (including, but not limited to, Promotion Game Play services) will void all Game Plays/Entries by that Entrant. In the event of a dispute as to any Game Play/Entry, the authorized account holder of the email address used to register will be deemed to be the Entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holders. All Entrants that complete a Game Play during the Promotion Period will automatically receive one (1) entry into the Sweepstakes drawing (“Entry”).
4. SWEEPSTAKES PRIZE RANDOM DRAWING/ODDS/SWEEPSTAKES PRIZE FULFILLMENT: On or about January 3, 2022, one (1) Grand Prize, one (1) First Prize, one (1) Second Prize, one (1) Third Prize, one (1) Fourth Prize, and one (1) Fifth Prize winner will be randomly selected from among all eligible Entries received throughout the Promotion Period. Drawing will be conducted by Administrator, whose decisions are final on all matters relating to the drawing. Odds of winning a Sweepstakes Prize depend upon the total number of eligible Entries received. The potential Sweepstakes Prize winners will automatically receive their prizes to the mailing addresses submitted on the Website at time of Entry. Return of any Sweepstakes Prize as undeliverable will result in disqualification and alternate selection.
5. VERIFICATION/INSTANT WINNER NOTIFICATION/INSTANT WIN PRIZE FULFILLMENT: All winners are subject to confirmation, verification of eligibility by Administrator and compliance with these Official Rules in Sponsor’s sole discretion. All material submitted becomes the sole property of the Sponsor and will not be returned. If, due to an error of any kind, more instant winning messages are delivered to Entrants, or more instant win Game prizes are claimed than are intended to be awarded per Rule #6, the intended number of Game prizes will be awarded in a random drawing from among all verified Game prize claims received during the Promotion Period. The Sponsor and its agencies assume no responsibility for any injury or damage to participants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Promotion. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of any prize. Instant Win Prize redemption codes will be fulfilled to the email addresses submitted on the Website (all Instant Win Prizes must be redeemed between 12/26/21 through 2/28/22). Return of any Instant Win prize as undeliverable will result in disqualification and prize will be forfeited. Unclaimed Instant Win Prizes will not be awarded.

Odds of winning a prize depend upon the total number of eligible entries received, estimated odds are based upon past promotions. Prizes are not transferable and must be accepted as awarded; no substitution or cash equivalent is allowed except by the Sponsor who reserves the right in their sole discretion to award prize of equal or greater value if advertised prize (or portion of prize) is unavailable. Winner may not request cash or a substitute prize. Taxes (if applicable) related to the prize are the responsibility of the winners. Limit of one (1) Instant Win prize and one (1) Sweepstakes Prize per person. *Instant Win Prizes can only be redeemed at participating Hickory Tavern locations, as indicated on the Website.
7. TRANSFER OF RIGHTS/PUBLICITY: Participation in the Promotion and accepting a prize constitutes Entrants’ consent for Sponsor and its designees to use Entrant’s name, likeness (if applicable), prize information, city and state of residence for advertising and promotional purposes in any and all media throughout the Universe in perpetuity without additional compensation, except where prohibited by law.
8. GENERAL RULES: By participating in the Promotion, Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and Administrator, whose decisions are final and binding in all matters related to the Promotion. Any normal Internet/phone access and data/usage charges imposed by Entrants’ online/phone service will apply and are Entrants’ sole responsibility. Sponsor is not responsible for any compatibility issues with Entrant’s Device/browser used for Game Play/Entry. Game Plays/Entries become the property of Sponsor upon receipt and will not be acknowledged or returned. Game Plays/Entries specifying an invalid, non-working, or inactive email address may be disqualified. No information regarding Game Plays/Entries, other than as otherwise set forth in these Official Rules or on the Website, will be disclosed. Sponsor is not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected Game Plays/Entries; or other error of any kind whether human, mechanical, or electronic. CAUTION: Any attempt to deliberately damage any Website/Device, or undermine the legitimate operations of the Promotion, is a violation of the criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such participant to the fullest extent permitted by law and to disqualify such Entrant from the Promotion. In the event the Promotion is compromised or impaired in any way for any reason, including but not limited to, fraud, virus, bug, unauthorized human intervention, outbreak of widespread illness, pandemic, or other similar occurrence, civil unrest or any other problem or other causes beyond the control of Sponsor that corrupts or impairs the administration, security, fairness, or proper play of the Promotion, Sponsor reserves the right in its sole discretion to suspend or terminate the Promotion and award the Instant win prizes claimed prior to cancellation and award all Sweepstakes Prizes from among all eligible Entries received prior to cancellation. Sponsor is not responsible for lost, late, misdirected, corrupted, or incomplete Game Plays/Entries. Proof of submission is not proof of receipt by Sponsor. By participating in this Promotion, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Game Play/Entry process or the operation of the Promotion, Sweepstakes or Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participation in the Promotion, Entrants and Prize winners release and hold harmless the Promotion Entities and their respective affiliates, subsidiaries, members, officers, directors, employees, agents and representatives (collectively, “Released Parties”) from and against any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting a Game Play/Entry or otherwise participating in any aspect of the Promotion, the receipt, ownership or use of any prize awarded, or while preparing for, participating in any prize-related activity or any typographical or other error in these Official Rules or the announcement or offering of any prize.
9. DISPUTES: Entrant agrees that: (a) he/she releases and will defend, indemnify and hold harmless the Released Parties from and all any and all claims; (b) claims arising out of or connected with this Promotion, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Charlotte, NC; (c) Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of North Carolina for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all claims, judgments, and awards shall be limited to actual damages of no more than $100, including costs associated with entering this Promotion, but in no event attorneys' fees; and (e) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants or the Released Parties in connection with this Promotion shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of North Carolina, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
10. PRIVACY POLICY: Information collected by Sponsor in connection with this Promotion may be used by Sponsor and shared with third parties involved in administration of the Promotion in accordance with the Sponsor’s online Privacy Policy posted at https://www.cokeconsolidated.com/assets/Privacy%20Policy%20Final%203_27_2017.pdf. The Entrant agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Promotion.

ADDENDUM TO OFFICIAL RULES: Effective 12/17/2021, the number of 1 Free Appetizer, $5 Hickory Tavern Bucks and $10 Hickory Tavern Bucks Instant Win Prizes have increased to the number of prizes indicated in section 6.
